Citizenship of Xity

Citizenship of Xity is governed by Part 10 of the Constitution (Articles 120 through 140) and the Third Schedule. The Constitution provides four paths to citizenship, rules for loss and deprivation, and protections for minors. The administrative process for applications is being established.

Four paths to citizenship

The Constitution provides four modes by which a person becomes, or is recognised as, a citizen of Xity.

Article 121
Citizenship by birth
A person born in the territory of Xity on or after the commencement of the Constitution is a citizen of Xity by birth, subject to such qualifications as may be prescribed by law.
Article 122
Citizenship by descent
A person born outside Xity on or after the commencement of the Constitution is a citizen of Xity by descent if, at the time of birth, his father or mother is a citizen of Xity.
Article 123
Citizenship by registration
The Constitution provides for citizenship by registration for persons who have resided in Xity or who have made a substantive contribution to the nation, subject to such conditions as may be prescribed by law.
Article 127
Citizenship by naturalisation
A person of full age and capacity who has resided in Xity for the prescribed period, who is of good character, and who has an adequate knowledge of the national language may be naturalised as a citizen.
Loss and restoration

How citizenship may end

The Constitution defines the circumstances in which citizenship may be renounced, deprived, or affected by a parent's loss of citizenship.

Article 128
Renunciation
A citizen of full age and capacity may renounce citizenship by declaration. Renunciation takes effect on registration of the declaration.
Article 129
Deprivation
Citizenship may be deprived by law in defined circumstances, including acquisition of foreign citizenship by voluntary act, or the exercise of rights of a foreign national in a manner inconsistent with Xity citizenship.
Article 130
Deprivation of a child
Where a person loses citizenship, the citizenship of a child of that person may also be affected as prescribed by law.
Article 138
Certificate in cases of doubt
Where any doubt exists as to whether a person is a citizen of Xity, the Government may grant a certificate of citizenship.
Rights and duties

What citizenship carries

Rights
Citizens of Xity are entitled to all the fundamental liberties guaranteed by Part 4 of the Constitution, including liberty of the person, equal protection, freedom of movement, speech, assembly, association, and religion. Citizens have the right to move freely throughout the territory of Xity, to participate in the Decentralised Governance System, and to vote in elections and referenda.
Duties
The Constitution establishes that citizenship carries obligations settled through the Personal Xity Wallet (PXW). All statutory obligations, including taxes and levies, are settled exclusively through registered wallets. The administrative framework for these obligations is being established.
Territory and entry

A nation without fixed borders

The Constitution provides that Xity is a decentralised nation without fixed territory. The framework for entry, residency, and host-country presence will be established by law under the Constitution. No immigration statutes have yet been enacted.

Territory model

Article 176 of the Constitution establishes Xity as a decentralised nation without fixed territory. The capital is a floating city capable of repositioning. Territory may include floating structures, artificial islands, and natural islands held by agreement. Xity may also reside temporarily within a host country on agreed terms. The rights of free movement under Article 13 extend to all territory held by the Republic.

Travel documents

The Constitution provides for vessels registered under the flag of Xity. A framework for travel documents has not yet been enacted. The administrative process will be established under the Constitution.
