Fundamental Liberties
Part 4 of the Constitution of the Republic of Xity, Articles 9 through 16. These liberties bind every branch of government and every institution of the state.
Constitutional status. These liberties are part of the Constitution of the Republic of Xity, enacted on 25 July 2026. They are binding on all institutions of the state, including the executive, the legislature, and the judiciary. Statutes giving them detailed effect are in preparation.
Part 4
The rights of every person in Xity
These eight liberties are the constitutional floor. No statute, regulation, or state action may diminish them except as the Constitution itself permits.
Article 9
Liberty of the person
No person shall be deprived of his life or personal liberty save in accordance with law.
Article 10
Slavery and forced labour prohibited
No person shall be held in slavery. All forms of forced labour are prohibited, but this does not prevent service required by law for a public emergency or work required while in lawful detention.
Article 11
Protection against retrospective criminal laws and repeated trials
No person shall be punished for an act that was not an offence under law at the time it was done. No person who has been acquitted or convicted of an offence shall be tried again for the same offence.
Article 12
Equal protection
All persons are equal before the law and entitled to the equal protection of the law.
Article 13
Prohibition of banishment and freedom of movement
No citizen shall be banished or excluded from the territory of Xity. Every citizen has the right to move freely throughout Xity.
Article 14
Freedom of speech, assembly and association
Every citizen has the right to freedom of speech and expression, to assemble peaceably and without arms, and to form associations.
Article 15
Freedom of religion
Every person has the right to profess and practise his religion and to propagate it. No person shall be required to receive instruction in or to take part in any ceremony or act of worship of a religion other than his own.
Article 16
Rights in respect of education
No religious community shall be prevented from providing religious instruction for pupils of that community in the course of any education maintained wholly or partly out of public funds. No person shall be required to receive religious instruction in a religion other than his own.
Supplementary protections
Other constitutional guarantees
Beyond Part 4, the Constitution provides additional protections in specific domains.
Freedom of religion (Article 180)
The Republic supports and protects all religions and all beliefs. No religion is established as the official religion. No discrimination on the ground of religion, belief, or race.
Sovereignty protection (Article 6)
No surrender of sovereignty or relinquishment of control over the Police Force or Armed Forces except by referendum of the citizens.
Due process (Article 11)
Protection against retrospective criminal laws and repeated trials. No punishment for an act that was not an offence when committed.
Movement (Article 13)
The right to move freely throughout Xity extends to all territory held by the Republic, including the floating capital and vessels registered under the flag of Xity.
Enforcement. These liberties are enforced by the courts. The Constitution establishes the Supreme Court of Xity with judicial power to determine whether any law or state action is inconsistent with these liberties. The judiciary is independent and judges hold security of tenure.
